After enduring a painful and unjust 15-year incarceration, a man, whose identity remains confidential for security reasons, has finally been set free. Convicted for conspiracy to commit robbery and robbery, he was handed a harsh 30-year sentence, despite his claims of innocence. However, the tides have turned in his favor as the Court of Appeal, Criminal Division in Accra has acquitted and discharged him.
The long-awaited liberation was achieved when it was discovered that the appeal records available lacked sufficient evidence to establish his guilt beyond a reasonable doubt. This revelation prompted the Principal State Attorney, Stella Ohene Appiah, to submit a written statement acknowledging the loss of some records, not due to any fault of the appellant, but that the existing portions of the appeal record relevant to his case were insufficient to justify his conviction.
Taking these factors into account, Stella Ohene Appiah advocated for the appellant’s appeal against both his conviction and sentence to be granted. The Court, recognizing the importance of justice and fairness, carefully considered the available evidence and concluded that there was not enough proof to sustain his conviction. Consequently, they granted his appeal, acknowledging that justice must be rightfully served.
